DEFINITIONS

Parties

"You" and "your" refer to you, as a user of the Site. A "user" is someone who accesses, browsers, crawls, scrapes, or in any way uses the Site. "We," "us," and "our" refer to That Travel Company.

Content

"Content" means text, images, photos, audio, video, location data, and all other forms of data or communication. "Your Content" means Content that you submit or transmit to, through, or in connection with the Site, such as ratings, reviews, compliments, invitations, check-ins, messages, and information that you publicly display or displayed in your account profile. "User Content" means Content that users submit or transmit to, through, or in connection with the Site. "That Travel Company Content" means Content that we create and make available in connection with the Site. "Third Party Content" means Content that originates from parties other than That Travel Company or its users, which is made available in connection with the Site. "Site Content" means all of the Content that is made available in connection with the Site, including Your Content, User Content, Third Party Content, and That Travel Company Content.

IMPORTANT ADDITIONAL INFORMATION REGARDING YOUR BOOKING

You must not accept any booking unless you understand and agree with the following terms and conditions.

Emergency 24/7 Support: That Travel Company provides 24/7 Emergency Support services to our customers. For emergencies within 24 hours of departure or while you are travelling; if you are within the UK please call 0203 1517801.

 

Baggage Fees: Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.

Travel Agent: That Travel Company and its affiliated entities acts as a travel agent only. We sell various travel related products on behalf of numerous transport service providers numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators and hotels. That Travel Company does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. That Travel Company obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not That Travel Company.

Important Conditions: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. As noted above, by making the booking, you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes, fees or carrier imposed surcharges after full payment will be your responsibility) applicable to your purchase.

Price: That Travel Company offers a Clear Price Guarantee that states that the quote you receive from us when you book your selected itinerary plus any taxes and applicable fees will be the price you pay. This guarantee does not include any instantly purchased fares as these are prone to change upon final booking. To assure that your booking is covered by our Clear Price Guarantee, you must confirm acceptance of your booking and receive all travel documentation at that time. Late confirmations will be re-priced at current market values and That Travel Company will alert you to that change. Also, if any changes are made by government agencies or travel providers, That Travel Company will advise you immediately.

Cancellation: Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.

Final Payment: You may be required to make a deposit and such deposits are non-refundable. Final payment is required no less than 60 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. That Travel Company accepts debit card or credit cards (Visa, MasterCard, Maestro, Discover or Diners). Should you wish us to charge your credit card we may require you to read and sign a credit card charge form set out in the receipt.

Credit Card Transactions: If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against That Travel Company and in the event that payment has been made to That Travel Company by credit card, you agree that you will not seek to charge back your payment to That Travel Company. If That Travel Company incurs any costs, including but not limited to solicitors fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to That Travel Company via money order or cash immediately.

Travel Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by That Travel Company to you, constitutes a binding assurance or promise about the insurance. Please complete your travel insurance form, sign it and return it to us. If you decline travel insurance you will be required to accept a disclaimer. That Travel Company is not an insurance company and has no responsibility for the submission, payment or adjustment of any insurance claims. Any claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

Additional Fees: Additional taxes and surcharges (including carrier imposed surcharges) that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers.

Responsibility: We always do our best to make sure your travel arrangements are satisfactory. However, That Travel Company and its affiliates and their employees, shareholders, subsidiaries, officers, directors, successors, agents and assigns do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to That Travel Company or any of That Travel Company affiliated entities.

Liability: That Travel Company is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, That Travel Company is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to UK standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner’s risk. You may see the name That Travel Company affixed to motor vehicles, on signs around the hotel or elsewhere. This use of our name is purely for reasons of identification and does not denote ownership, supervision, or control by That Travel Company in any way. The prices of these tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that That Travel Company is not liable for any consequential loss or damage.

Passports: All individuals departing from the UK must be in possession of a valid passport. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the UK or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A government issued ID is required for travel within the UK.

Travel Documents: Travel documents including, without limitation, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being nonrefundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking.

Health and Special Requirements: It is your responsibility to ensure you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. Please advise your consultant of any special requirements you may have, for example, special meals, medical requirements and so on.

International Flights: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. For more information, please check with your airline provider.

Refusal of Service: Service providers reserve the right to refuse service to travellers at their sole discretion and including without limitation if the traveller:

• Lacks proper documentation for the country of destination

• Has a contagious disease

• Is under the influence of alcohol, drugs or narcotics

• Manifests disruptive and/or unruly behavior

Flights: That Travel Company acts as your sole agent when arranging scheduled flights and, as such, we charge an additional fee for this service. Your airline ticket will be issued under the supplier’s IATA licence and covered by that company’s ATOL.

This agreement will result in a binding contract between you and our supplier as well as the chosen airline. This contract indicates that you will be subject to the terms, conditions and various regulations set forth by stated airline as well as their specific cancellation and refund policies.

That Travel Company pays the airline on your behalf, charging you the flight costs plus our fee. Any additional charges that you incur with the airline will be charged to you directly. All details of your flights and the flight reference number will be sent to you by That Travel Company.

Hotels: That Travel Company represents a wide range of hotels and other accommodation-related venues. We book hotel accommodations on your behalf, acting as your booking agent. Any contract you enter into with the accommodation provider subjects you to the accommodation provider’s specific terms and conditions.

Cancellations may incur additional fees and are determined by a variety of factors.

Upon booking your accommodations, you will be entered into a contract with your chosen accommodation provider. That Travel Company acts as your booking agent and accepts no liability for accommodation arrangements, injury, illness, death, inconvenience, or loss of any kind. This includes the unavailability of any specific hotel services. Any and all claims relating to the above should be forwarded to the hotel or accommodation provider.

Cruises and Tours: That Travel Company represents a wide range of cruise and tour companies. We book cruises or tours on your behalf, acting as your booking agent. Any contract you enter into with the cruise or tour provider subjects you to the provider’s specific terms and conditions.

Cancellations may incur additional fees and are determined by a variety of factors.

Upon booking your cruise or tour, you will be entered into a contract with your chosen accommodation provider. That Travel Company acts as your booking agent and accepts no liability for cruise or tour company accommodation arrangements, injury, illness, death, inconvenience, or loss of any kind. This includes the unavailability of any specific services during your tour or cruise. Any and all claims relating to the above should be forwarded to the cruise and tour companies directly.

Train and Attraction Tickets: That Travel Company acts on our clients’ behalf as their agent when booking flights hotels and train and attraction tickets. As your agent, our company charges a fee for our services. We will perform all booking procedures for you and you will have a contract with the train or attraction company. As such, you will be subject to any and all terms and conditions set forth by the operator.

That Travel Company will forward any details of your journey including, but not limited to, your ticket and any restrictions to its use, as well as any reference numbers that you may require.

Cancellations often incur a penalty or cancellation fee to be paid by you, the client. That Travel Company can pay the fee on your behalf as well as any costs for the initial booking. Any further charges incurred by you will be charged to you directly.

When booking your train or attraction service, you will be entered into a contract with your chosen operator. That Travel Company acts as your booking agent and accepts no liability for any operator accommodation arrangements, injury, illness, death, inconvenience, or loss of any kind. This includes the unavailability of any specific services. Any and all claims relating to the above should be forwarded to the train or attraction companies directly.

Car Hire: That Travel Company represents a multitude of car hire companies and act as an agent for our clients when booking or contracting the car hire services. Any resulting contract is between our client and the car hire company subjecting our clients to the terms and conditions of that company.

Cancellations may incur additional fees and are determined by a variety of factors.

As the booking agent for your car hire services, That Travel Company accepts no liability for the car hire arrangements and are excluded from liability for injury, illness, death, inconvenience, or loss of any kind, or for the unavailability of any car hire services. Any and all claims relating to the above should be forwarded to the cruise and tour companies directly.

Payment, Tickets and Deliveries:

That Travel Company accepts a variety of payments including:

• Visa

• MasterCard

• Maestro

• Visa Electron

• Cheque

• BACS

• Standing Order

 

Please note all deposits are 100% non-refundable.

As soon as That Travel Company receives payment, any travel documents will be forwarded to you, the client. Any clients using credit facilities will be issued travel documents instantly.

For late bookings, usually within 3 days of departure, travel documents will be sent via special delivery In the event of late bookings it may be necessary for your travel documents to be sent to you by special delivery. This may incur extra charges by us or our suppliers.

Changes Made by You: That Travel Company understands that life happens and, from time to time, plans change. If you need to make changes to your travel arrangements after booking confirmation, our team will do everything we can to accommodate those changes. Please keep in mind, some changes may not be possible as it may be too late or that particular booking is not changeable.

We do charge an amendment fee of £20 per person and this fee is in addition to any charges passed on by our suppliers. All changes are subject to the booking conditions of the supplier and these conditions can be made available to you beforehand if necessary.

Amendment fees and provider fees do tend to increase as the date of departure becomes close and you will not be able to amend certain travel arrangements that have already been made.

Cancellation by You: To cancel all, or any portion of your travel arrangements, written notification is required by That Travel Company. Any time travel arrangements are cancelled, the booking agent incurs costs and these costs are passed on to the client as well as any fees charged by our suppliers.

Some bookings are not refundable and these can be found in our suppliers’ terms and conditions. These terms and conditions are available to you, upon request, and should be viewed prior to booking.

You may, however, reclaim many of your cancellation fees if the reason for your cancellation is covered in a travel insurance policy. Be sure to understand all cancellation fees and losses that you may incur before requesting any cancellations.

If You have a Complaint: If you have any issues, problems or complaints during your travels, let your voice be heard. Bring any issues that you have to the attention of the relevant supplier immediately and follow any specific complaint reports or documentation requested.

Usually, complaints can be resolved quickly by contacting the supplier and explaining the issue. If you are still not satisfied with your resolution, contact That Travel Company in writing within 28 days of returning from your holiday.
